The QME system is designed with more or less as a flat rate payment schedule to the examining physicians.

What happens when the insurance carriers ignore the QME doctors?

The WCAB is poorly set up to handle this type of dispute.

A Judge in San Diego County has designed a form that puts all parties on notice that the facts are being presented to the judge before a lien need be filed. (which is difficult to do with out a case number)

I have yet to have one carrier ignore the form.
